Paternity

Paternity refers to a legal action to establish that a certain man is the father of a certain child. A paternity action may be brought in order to impose a child support obligation, establish a right to inheritance, secure consent for the child's adoption, or gain custody or parental access rights. Establishing paternity may also be a critical contribution to a child's sense of identity.

Our firm has handled hundreds of paternity cases, involving both representation of men and women. The paternity area is a significant and complex area of family law, involving sophisticated techniques for determining paternity, custody and/or visitation litigation, states of limitations, negotiation often including mediation.

It is important to understand that unmarried fathers are given no paternity rights, unless they petition the court, even if they've signed a Recognition of Parentage form at the hospital when the child was born. However child support may be taken from a father even before his legal rights are established, retroactively in some cases, for up to two years.
