A child abduction occurs when someone takes, withholds or conceals a child in violation of a custody or visitation order. If your child has been abducted by the father or mother in violation of a custody or visitation order, call the police and file a report as soon as possible. They will ask you to provide copies of your most recent court orders regarding custody. You should also immediately notify the District Attorney's Office Child Abduction Unit of your county.
We represent Minnesota parents whose children have been abducted by their mothers or fathers and taken to other states or foreign countries. The Uniform Child Custody Jurisdiction Act (UCCJA) governs jurisdiction in interstate custody and visitation cases and requires interstate enforcement and non-modification of sister-state custody orders. If your child has been taken to a foreign country and the country is a member of the Hague Convention on the Civil Aspects of International Child Abduction, we can begin legal steps to regain custody of your child.
In one of the child abduction cases we handled, the mother took the child to a refugee camp in southern India to live with relatives, denying the father his parenting rights. The mother returned to Minnesota to work. While living in the refugee camp, the child lost some ability to speak English and also resorted to begging behavior. We represented the father and filed a motion for a change of custody. After a full trial, custody was awarded to our client and the child was returned to the father.
